Welcome to Spotzy (“Spotzy,” “we,” “our,” or “us”).

These Terms & Conditions (“Terms” or “Agreement”) govern your access to and use of the Spotzy mobile application, website, content, services, and features (collectively, the “Service”).

By accessing or using Spotzy, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, you must immediately stop using the Service.

ARTICLE 1 — ACCEPTANCE OF TERMS

1.1 Binding Agreement

By creating an account, browsing locations, submitting content, or otherwise using the Service, you agree to be legally bound by these Terms, our Privacy Policy, and all additional guidelines we may publish.

1.2 Eligibility

You must be:

• At least 18 years old; and
• Legally capable of entering a binding contract.

If you are under 18, you must have a legal parent or guardian in-company of the minor in any trips, vacations, or travels that you attend under the spotzy app.

1.3 Updates to Terms

We may update these Terms at any time for legal, operational, or safety reasons. The latest version will always be posted in the app or on our website. Continued use after changes means you accept the new Terms.

ARTICLE 2 — ABOUT SPOTZY

2.1 Service Purpose

Spotzy provides users with access to low-tourism travel destinations, scenic lookouts, hidden gems, and under-visited locations around the world. Our goal is to showcase lesser-known destinations and help users explore places free from typical overcrowded tourism.

2.2 No Guarantees

We do not guarantee:

• Tourism levels at any listed location
• Real-time accuracy of crowds, accessibility, safety, or conditions
• That you will be able to enter, access, or visit any location

The Service provides informational content only, not verified travel data.

ARTICLE 3 — USER ACCOUNTS

3.1 Account Creation

You must provide accurate, truthful information. You may not create an account using:

• False identities
• Someone else’s personal data
• Disposable or fraudulent emails

3.2 Account Security

You are responsible for keeping your password secure. You agree not to share your login credentials or allow unauthorized access. You accept all responsibility for activity under your account.

3.3 Account Termination

We may suspend or terminate accounts for:

• Violations of these Terms
• Illegal activity
• Abusive behavior
• Content that violates laws or platform rules
• Attempts to exploit or misuse the Service

You may request deletion of your account at any time.

ARTICLE 4 — USER CONTENT & INTELLECTUAL PROPERTY

4.1 User Content Ownership

You retain ownership of content you post, including photos, reviews, videos, or destination suggestions.

4.2 License to Spotzy

By posting content, you grant Spotzy a worldwide, royalty-free license to use, modify, display, distribute, and reproduce such content for the operation, improvement, and promotion of the Service.

4.3 Prohibited Content

You may NOT submit content that:

• Contains hate speech, harassment, bullying, threats, or violence
• Contains nudity or sexually explicit material
• Includes illegal activity or unsafe behavior
• Contains copyrighted materials without permission
• Encourages trespassing or unsafe travel practices
• Misrepresents factual information about locations

4.4 Intellectual Property Rights

All Spotzy branding, logos, text, graphics, UI, code, databases, and design belong exclusively to Spotzy and may not be copied, modified, or reproduced without written permission.

ARTICLE 5 — LOCATION INFORMATION & DISCLAIMERS

5.1 General Disclaimer

All location descriptions, photos, travel information, and overviews provided within the Service are for informational and entertainment purposes only. Spotzy does NOT guarantee:

• Accuracy
• Safety
• Accessibility
• Condition of trails, roads, or lookout points
• Open/closed status
• Tourism level or crowd density
• Weather conditions
• Legal permissions for entry

5.2 No Liability for Travel Risks

You acknowledge that visiting outdoor, remote, or low-tourism locations carries inherent risks including injury, wildlife encounters, accidents, environmental hazards, weather conditions, and other unpredictable dangers. Spotzy is not liable for:

• Physical injuries
• Damages
• Death
• Theft
• Property loss
• Fines or legal consequences
• Any travel or accommodation expenses

5.3 External Sources

Information may be sourced from public materials, user submissions, or third-party references. Accuracy cannot be guaranteed.

ARTICLE 6 — PROHIBITED USES

You may NOT use Spotzy for:

• Any illegal activity
• Trespassing or accessing private property
• Harassment, stalking, or endangering others
• Collecting data for commercial resale
• Attempting to hack, reverse engineer, or disrupt the Service
• Uploading malware, spyware, or malicious code
• Spamming, automated bots, or scraping
• Misleading or fraudulent submissions
• Advertising without permission
• Posting unsafe recommendations or instructions

Violation may result in immediate termination and potential legal action.

These Terms are governed by the laws of the United States and the state in which Spotzy is headquartered, without regard to conflict-of-law rules.

All disputes will be resolved through binding arbitration rather than court litigation.

You waive:

11.3 Venue

Arbitration will occur in the state of Spotzy’s headquarters unless mutually agreed otherwise.

These Terms constitute the entire agreement between you and Spotzy.

12.2 Severability

If a clause is found unenforceable, the rest remains valid.

12.3 No Waiver

Failure to enforce a right does not waive that right.

We may transfer our rights under these Terms. You may not assign your rights without consent.
